Welcome to Darlington Estate Jewellery. These Terms & Conditions apply to your use of our website and to purchases made through Darlington Estate Jewellery.
By using our website or placing an order, you agree to these Terms & Conditions.
1. About Darlington Estate Jewellery
Darlington Estate Jewellery is a family-owned Australian business based on the Gold Coast, Queensland. We specialise in carefully selected pre-loved, vintage and antique fine jewellery, including natural gemstones and precious metals.
Each piece is individually selected and, where reasonably possible, inspected and tested before being offered for sale. Because our jewellery is predominantly pre-loved, vintage and antique, individual pieces may show signs of age and previous wear.
2. Product Descriptions
We make every reasonable effort to ensure that product descriptions, photographs, measurements, weights, gemstone information, metal purity and other product details are accurate. Product photographs are intended to provide an accurate representation of the item. Colours may vary slightly depending on lighting, photography, screen settings and the device used to view the website.
Measurements and weights are provided as accurately as reasonably possible and may have minor variations. Where a gemstone, maker, age, origin, treatment or other characteristic cannot be independently confirmed, we will describe the information accordingly. Customers are encouraged to contact us before purchasing if they require additional information, photographs, measurements or clarification.
3. Pre-Loved, Vintage & Antique Jewellery
Unless otherwise stated, jewellery offered by Darlington Estate Jewellery is pre-loved. Pre-loved, vintage and antique jewellery may naturally display characteristics associated with age and previous use, including:

minor scratches or surface marks

signs of wear

patina or age-related changes

small imperfections
-
previous repairs or alterations
-
variations in colour or finish
-
evidence of previous use.
Where we are aware of significant condition issues, repairs, alterations or damage, we aim to disclose them in the individual product description. Normal signs of age and wear that have been accurately disclosed are not considered undisclosed faults.
4. Natural Gemstones
Darlington Estate Jewellery specialises in natural gemstones.
Where a gemstone has been identified as natural, treated, enhanced, synthetic, laboratory-grown or otherwise altered, we will describe this information where known and appropriate. Where specialist testing or certification has not been undertaken, we will not represent unconfirmed characteristics as independently verified facts.
5. Jewellery Valuations & Certificates
Any valuation, certificate or report supplied with a piece is provided as documentation associated with that item. A valuation is not necessarily the same as the purchase price, replacement value, insurance value or current market value.
Where a certificate or valuation has been issued by an independent third party, it does not constitute a guarantee of future market value.
6. Pricing
All prices displayed on our website are in Australian dollars (AUD), unless otherwise stated. Prices may change without notice. The price displayed at the time an order is accepted will generally apply to that order. We reserve the right to correct genuine pricing or typographical errors. If an obvious pricing error occurs, we will contact the customer before processing the order and provide the opportunity to confirm whether they wish to proceed at the correct price.
7. Availability
Our collection consists largely of unique, one-of-a-kind or limited pieces. Items may sell quickly and may become unavailable without notice. Adding an item to a shopping cart does not necessarily reserve or secure the item. An item is considered sold once payment has been successfully received and the order has been accepted by Darlington Estate Jewellery.
8. Orders & Acceptance
Submitting an order through our website constitutes an offer to purchase the selected item. An automated order confirmation does not necessarily constitute final acceptance. We reserve the right to decline or cancel an order where there is a genuine reason, including:

an obvious pricing or description error

suspected fraudulent activity

payment not being successfully received

circumstances outside our reasonable control.
If we cancel an order after payment has been received, the amount paid will be refunded.
9. Payment
Payment must be received in full before an item is dispatched unless an alternative arrangement has been expressly agreed in writing.

Customers are responsible for ensuring that payment and contact information supplied to us is accurate.
10. Payment Plans
Where Darlington Estate Jewellery agrees to a payment plan, the terms of that arrangement will be confirmed separately with the customer. Unless otherwise agreed in writing, an item will not be dispatched until payment has been received in full. Payment plans may have separate terms relating to deposits, payment dates, cancellations and defaults.
11. Shipping & Delivery
Our Shipping & Delivery Policy forms part of these Terms & Conditions. We take reasonable care when packaging jewellery for delivery. Delivery arrangements, estimated delivery times and applicable insurance or transit cover are described in our Shipping & Delivery Policy. Nothing in these Terms & Conditions limits any rights or remedies available under Australian law.
12. Returns, Refunds & Consumer Guarantees
Our Refund & Returns Policy forms part of these Terms & Conditions.
We do not generally offer refunds or exchanges for change of mind.
Nothing in these Terms & Conditions or our Refund & Returns Policy excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under the Australian
Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
13. Care of Jewellery
Customers are responsible for taking reasonable care of jewellery after purchase.
Certain gemstones, antique pieces, settings, chains and other jewellery components may require particular care. Where appropriate, we may provide specific care information with the item or in its product description. Damage caused by misuse, accidental damage, inappropriate care, alteration or repair by another jeweller or third party may not be covered by any voluntary warranty or return policy. This does not limit rights available under the Australian Consumer Law.
14. Website Content & Intellectual Property
All content appearing on the Darlington Estate Jewellery website, including photographs, product descriptions, logos, branding, text, graphics and other material, is owned by or licensed to Darlington Estate Jewellery unless otherwise stated.
You must not reproduce, copy, modify, publish, distribute or commercially use our website content without written permission. Product photographs may not be copied or used for other listings, advertisements or commercial purposes without permission.

You agree to use our website lawfully and responsibly.

We are not responsible for the operation of third-party websites or services outside our reasonable control.

Personal information is handled in accordance with our Privacy Policy. Our website uses Wix and may use third-party services necessary to process payments, fulfil orders, provide delivery services, operate the website and support promotional activities.
19. Promotions & Discounts
Promotional offers, discount codes and sales may be subject to additional terms specified at the time of the promotion.
Unless otherwise stated:

promotional codes cannot be exchanged for cash

promotional discounts cannot be applied retrospectively

only one promotional code may be used per transaction

promotional offers may exclude selected products or categories.
Specific promotional terms displayed with an offer will take precedence over these general terms.

Changes will not affect rights or obligations that have already arisen under a completed purchase.

These Terms & Conditions are governed by the laws of Queensland, Australia, subject always to any rights a consumer may have under Australian law.
